Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Exotic Notes website and mobile application (the "Service") operated by Exotic Technologies ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.

1. Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password and any other credentials that you use to access the Service, and for any activities or actions performed under your account. We store account information, including your email address and password, using industry-standard security practices, including encryption of passwords. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to comply with this section.

You are free to create an account and you may delete your account at any time through your account settings or by contacting us. Upon deletion, your account information will be removed or anonymized in accordance with our data retention practices, except where we are required to retain certain information to comply with legal obligations, resolve disputes, or enforce our agreements.

2. Use of the Service

Exotic Notes provides lesson notes, schemes of work, sample lessons, video lessons, documents, and related educational materials (the "Content") for viewing, downloading, and in some cases uploading. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Service in any way that violates any applicable national or international law or regulation.
• Upload, transmit, or distribute any content that is unlawful, defamatory, infringing, obscene, or otherwise objectionable.
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service.
• Use any automated means, including bots, scrapers, or spiders, to access the Service for any purpose without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service.

3. User-Generated and Uploaded Content

Certain features of the Service may allow you to upload, submit, or share documents and other materials ("User Content"). You retain any ownership rights you already hold in your User Content, but by uploading it to the Service, you grant Exotic Technologies a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service.

You represent and warrant that you own or have the necessary rights to any content you upload, and that such content does not infringe the intellectual property rights or other rights of any third party.

You may delete content you have uploaded at any time, and we will remove it from active display, though copies may persist temporarily in backups before being purged in the ordinary course of our data management. We also reserve the right, but not the obligation, to review, monitor, and remove any User Content at our sole discretion, including content that we believe violates these Terms.

4. Intellectual Property

Unless otherwise stated, the Service and its original content, features, and functionality (excluding User Content) are and will remain the exclusive property of Exotic Technologies and its licensors. The Content provided through the Service is intended for personal and, where applicable, classroom or institutional educational use. You may not reproduce, distribute, sell, or commercially exploit any Content obtained through the Service without our prior written permission.

5. Downloading and Uploading

Some Content may be made available for download for offline use. Downloaded materials remain subject to these Terms and to applicable copyright protections, and are provided for your own personal or institutional educational use only, unless otherwise indicated. We do not guarantee uninterrupted availability of download or upload functionality and are not liable for any loss of data arising from interruptions, errors, or technical failures during these processes.

6. Advertising

The Service may display advertisements and promotions from us and from third parties. By using the Service, you agree that we may place such advertising. We and our advertising partners may use an advertising identifier (such as a mobile device's advertising ID) and similar technologies to deliver, measure, and personalize advertising and to understand how users interact with ads. You may be able to limit the use of your advertising identifier through your device settings.

We are not responsible for the content of third-party advertisements or for any products or services advertised through the Service. Any dealings you have with advertisers found through the Service are solely between you and the advertiser.

7. Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. You may also stop using the Service and delete your account at any time, as described in Section 1.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimer of Warranties

The Service and all Content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any Content is accurate, complete, or current. Educational materials are provided for reference and study support purposes, and we make no guarantee regarding examination outcomes or academic results arising from their use.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Exotic Technologies, its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of, or inability to use, the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless Exotic Technologies and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect, such as by posting a notice on the Service or updating the "Last updated" date above. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect, and the invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.
